Biden's New Parole Program

Immigrants may receive parole even if they do not qualify for other forms of relief. Parole provides a temporary, discretionary measure allowing entry into the United States. This option has been extended to victims of human trafficking and those assisting law enforcement investigations. Historically, individuals facing significant medical issues, domestic violence, or criminal cases have also been granted parole.
On June 18, 2024, the Biden Administration announced a new parole program. This parole program is specifically designed for immigrants who entered the U.S. “without inspection” or crossed the U.S. border without approval, and who wish to become legal permanent residents and then apply for citizenship. Typically, the process is very difficult, even resulting in immigrants who have been unable to obtain green cards even though they are eligible. However, the new parole program allows the executive brand to grant “humanitarian parole” to certain immigrants who do not have a lawful basis to enter or stay in the United States.

What Is the Purpose of Biden's New Parole Program?
The purpose of the new parole program is to provide a legal pathway for immigrants who are the spouses of U.S. citizens to become citizens themselves. The program is also designed to promote family unity by allowing these individuals to remain in the United States with their family members.
Who Is Eligible for Biden's New Parole Program?
To be qualified for Biden's new parole program, an individual must fulfill a number of standards, such as:
- Have lived continuously in the United States since June 17, 2014;
- Were physically in the United States on June 17, 2024
- As of June 17, 2024, have been lawfully wed to a citizen of the United States;
- Entered the country without authorization or parole, and they now don't have a valid immigration status;
- Have not been found guilty of any crimes that disqualify them;
- Does not endanger public safety or national security; and
- Merits a favorable exercise of discretion.
